Before committing any money, it is worth knowing the total cost of the transaction, checking the property’s legal and planning status, and understanding the obligations you take on when signing each document.

This guide brings together the essential points for first-time buyers, those looking for a second home on the Costa del Sol and those buying a property from abroad. The aim is to help you move forward with clear information and ask the right questions at each stage.

1. Define how you will use the home and your real budget

The search changes depending on whether you want to live there all year round, enjoy a second home or buy as an investment. A home that is excellent for holidays is not always comfortable for everyday life; a property that looks attractive on paper may need renovation, have high community fees or be subject to restrictions on use.

Before viewing properties, work out how much you can spend on the purchase in addition to the advertised price. Include taxes, notary and Land Registry fees, any professional fees, a valuation if you need a mortgage, renovation work and a margin for the unexpected. Also add the recurring costs: community fees, IBI (property tax), insurance, utilities and maintenance.

If you will be financing the purchase, speak to the bank before signing any payment commitment. The amount the bank is willing to lend will depend on its affordability assessment and the valuation, among other factors. A pre-assessment helps you search with a realistic budget, but it is not the same as final approval.

2. Check who is selling and what is being sold

The nota simple from the Land Registry allows you to check the registered ownership of the property, its description and any registered charges, such as mortgages or attachments. Request an up-to-date nota simple and check that the person signing is entitled to sell. If there are several owners, an unresolved inheritance or a company selling, the powers of those involved will also need to be verified.

The nota simple is the starting point, but it does not replace the other checks. Compare the registry description with the cadastral information and with the physical reality: floor area, terraces, outbuildings, garage, storage room and boundaries. If you find discrepancies, clarify them before paying a deposit. An extension or visible renovation should not be assumed to be legal just because it physically exists.

Also ask for information on the property’s position with the owners’ association, IBI and utilities. Check whether it will be handed over free of occupants and tenancies, or which existing contract you will have to respect. In the case of a detached house, a rural property or a property with extensions, it is worth paying particular attention to the planning situation and seeking specific technical and legal advice.

3. Review the documentation and the physical condition

Before deciding, ask for the documents relevant to the type of home: cadastral reference, energy performance certificate, applicable planning or occupancy documentation, certificate of community debts and the latest tax and utility bills. For new builds, also review the development documentation, plans, specifications, delivery dates and the guarantees for any advance payments.

Take your time viewing the property. Check for damp, the installations, windows, orientation, noise and the condition of the communal areas. If the purchase involves major renovation or there are doubts about the structure and installations, an inspection by an independent professional can prevent costly decisions. On the Costa del Sol, sun exposure, ventilation, pool and garden maintenance and the costs of developments with extensive services also deserve attention.

If you intend to rent the home to tourists, do not assume that you will be able to. You must check the current municipal and regional regulations, as well as the owners’ association rules and the registration requirements applicable to that specific home. Whether or not holiday letting is allowed can be decisive for an investment purchase.

4. Understand the reservation contract and the deposit before signing

A reservation or deposit contract (contrato de arras) can be legally binding even before you go to the notary. That is why every payment and every document must clearly state who is buying and selling, which property is being transferred, the total price, the amount paid, the deadline for signing the deed, how costs are shared and the condition in which the home will be handed over.

Not all deposits have the same consequences. Their effect depends on the wording and the type of agreement signed; you should not assume that you can always withdraw by losing only the deposit. If you depend on a mortgage, negotiate before signing what will happen if financing is not granted and how this must be proven. Charges, the handover of keys, included furniture and any issues identified in the document review should also be settled.

The practical rule is simple: do not hand over a significant amount until you understand the contract and have checked the essential points about the property. If legal questions arise, consult an independent lawyer or the notary before committing.

5. Calculate the taxes according to the type of property

In Spain, the taxation of a purchase depends, among other factors, on whether it is the first transfer of a new home or a resale home, and on the autonomous community where it is located.

Type of purchase in Andalusia

Main tax for the buyer

General indicative rate

Resale home, subject to property transfer tax

ITP (TPO)

7%

First transfer of a new home, subject to VAT

VAT (IVA)

10%

Deed of purchase of a new home subject to VAT

AJD (stamp duty), in addition to VAT

1.2%

Reduced rates or special cases may apply if specific requirements are met. For resale homes, also check the cadastral reference value, as it may affect the taxable base for ITP. For example, a resale home bought for €500,000 would mean €35,000 in ITP, applying the general Andalusian rate of 7% to a base of €500,000; the actual base must be confirmed for each transaction. Notary, registry and other costs are budgeted separately.

If the seller is not tax resident in Spain, the buyer may be required to withhold and pay 3% of the price using form 211. This is not an additional tax on the purchase, but a payment on account of the seller’s tax, which must be handled correctly at the signing of the deed.

6. If you are buying from abroad, prepare the paperwork in advance

Foreign buyers need to organise their identification and method of payment. The NIE is the foreigner identification number used for financial and administrative procedures in Spain. If you do not yet have one, it is advisable to apply in good time to avoid delays in signing. You will also need to prepare your identity document, the documentation requested by the notary and, if there is financing, the financial documentation required by the bank.

A Spanish bank account can make payments, bills and taxes easier, but whether you actually need one depends on how the transaction is structured and the institutions involved. If you will not be able to attend in person, ask in advance about granting a sufficient power of attorney. Documents issued abroad may require a sworn translation or legalisation, depending on the case.

Buying a home does not in itself grant a right of residence. If you plan to live in Spain on a regular basis, review your immigration and tax requirements separately. Non-resident owners may also have ongoing tax obligations, even when the home is for their own use.

7. Coordinate the mortgage, the deed and registration

If you apply for a mortgage, compare not only the interest rate but also the total cost, the conditions, the linked products and the consequences of early repayment. The bank must provide the relevant pre-contractual documentation, including the FEIN (European Standardised Information Sheet), within the legal timeframe so that you can study it before signing. Distinguish between the costs of the purchase and those of arranging the mortgage loan: they are not shared in the same way.

The purchase is usually formalised by public deed before a notary. At that point, the identity of the parties, the title, the means of payment and the conditions of the transfer are reviewed. Afterwards, the taxes must be paid, the deed submitted to the Land Registry and the change of ownership of utilities and services arranged. Keep a copy of the deed and the proofs of payment.

A short checklist before paying the deposit

Do you know the total purchase cost and the annual running costs?

Have you checked ownership, charges and that the Registry, the Cadastre and the actual property match?

Is the planning, occupancy and tenancy situation clear?

Have you reviewed community fees, IBI, utilities and the energy certificate?

Do you understand what happens to the deposit if the deadline changes or financing falls through?

Have you confirmed the applicable taxes and, where relevant, the obligations arising from a non-resident seller?

Have you verified any special use you want to make of the property, such as holiday letting?

Buying with the right information changes the experience

A good purchase does not begin at the notary’s office: it begins when you carry out the right checks and can assess each property with data, not just impressions. Preparing your budget, reviewing the documentation and coordinating the bank, the notary and independent professionals in good time allows you to move forward with more clarity and fewer surprises.

At RIVA CELESTE we support you in your search for a home on the Costa del Sol, organise the information on each property and help you coordinate the different stages of the transaction.
